Questions and notes on the procurement documents and the subject of the contract must be clearly separated from objections. Questions, notes and objections must be submitted electronically via bidder communication through the procurement portal dtvp.de to the contact point mentioned under I.1. They must be formulated in German.
The answers will be automatically made available to all companies that have registered for the procurement procedure via bidder communication through the procurement portal.
Important: Companies that have downloaded the procurement documents without registration are responsible for following the contracting authority's further communication. The bidder is obliged to inform themselves regularly and retrieve the relevant information.
Bidding Consortia​
Bidding consortia must submit a declaration signed by all members with their offer. The prerequisites and evidence listed in sections III.2.1 to III.2.3 must be provided for all members. Bidding consortia are jointly and severally liable for the fulfillment of contractual obligations.
Subcontractors​
The involvement of subcontractors for individual partial services is possible in each case. The transfer of partial services to subcontractors requires prior written consent from the contracting authority (§ 4 Abs. 4, S. 2. VOL/B remains unaffected).
The bidder must with submission of the offer:
- Notify the circumstance of the use of subcontractors
- Communicate the type and scope of services to be awarded to the subcontractor(s) through a corresponding declaration
- Prove that the necessary resources will be available to them in case of contract award by submitting a corresponding commitment declaration from the named subcontractor(s) regarding access and performance capability (§§ 36, 47 VgV)
In this case, the contracting authority's consent is deemed granted with the contract award.
Note: Companies affiliated with the bidder in the sense of corporate law are also to be regarded as subcontractors in the event of their inclusion in service provision by the bidder.

Review Deadlines​
§ 134 GWB - Information and Waiting Obligations​
(1) Contracting authorities must inform bidders whose tenders are not to be considered about the name of the company whose tender is to be accepted, the reasons for the intended non-consideration of their tender, and the earliest date of contract conclusion immediately in text form.
(2) A contract may only be concluded 15 calendar days after sending the information according to paragraph 1. If the information is sent electronically or by fax, the period is reduced to ten calendar days.
(3) The information obligation does not apply in cases where the negotiated procedure without competition is justified due to special urgency.
§ 135 GWB - Invalidity​
(1) A public contract is invalid from the beginning if the contracting authority has violated § 134.
§ 160 GWB - Initiation, Application​
(1) The procurement chamber initiates a review procedure only upon application.
(2) Every company that has an interest in the public contract or concession and claims a violation of its rights according to § 97 paragraph 6 through non-compliance with procurement regulations is entitled to apply.
(3) The application is inadmissible if:
- The applicant recognized the asserted violation of procurement regulations before submitting the review application and did not object to the contracting authority within a period of 10 calendar days
- Violations of procurement regulations that are recognizable from the notice are not objected to the contracting authority at the latest by the deadline stated in the notice for application or tender submission
- Violations of procurement regulations that are only recognizable in the procurement documents are not objected to the contracting authority at the latest by the deadline for application or tender submission
- More than 15 calendar days have passed since receipt of the contracting authority's notification that it does not wish to remedy an objection
§ 168 GWB - Decision of the Procurement Chamber​
(1) The procurement chamber decides whether the applicant's rights have been violated and takes appropriate measures to eliminate a violation of rights and prevent damage to the affected interests.
(2) A validly granted contract cannot be lifted.
